Hi. Male guy seeking advice on this.
Need advice regarding separation and divorce and its impact to HDB ownership.
Can both still keep the HDB upon separation and divorce until the couple is ready to sell it away?
Do I need to engage a law firm to do separation or divorce?
What advices do u have?
Thanks.

I think the correct question is "do you still have a share in the hdb post divorce".
Remember, WC is a powerful tool to pawn married men in Singapore. I know diverced men who lost their HDB and part of CPF to their ex-wife

The point of a divorce is to seek a clean break and a fresh beginning. Why seek a divorce if you intend to hold joint assets after the divorce is finalised? The intention to divorce is questionable.
The hdb you bought is based on a family nucleus. I have friends who bought out each other's share after a divorce. So end up the husband is the sole owner now and the transaction was completed provided he's above 35 and MOP period is fulfilled.

I want a clean break but have a kid that will be going uni next year.
Thus I知 wondering if filing for separation first and after kid graduates from uni then I file for divorce.
I知 already sleeping in separate room.
If I file for separation, hdb will not require the hdb to be sold right? Only when divorce?

I had a guy friend who divorced and he let his wife get his share of the hdb. She needs to pay back the amount he had utilized from his cpf, including cpf interest. So I知 thinking that arrangement will be fine for me.
But how can ex spouse claim part of their cpf? That痴 really absurd WC.

my personal opinion:
I want a clean break but have a kid that will be going uni next year. - just have the money to fund his/her uni thats all. whether you divorce or not should not affect your kid much as he/she's a young adult now.
Thus I’m wondering if filing for separation first and after kid graduates from uni then I file for divorce. - can. have you discussed this with your spouse? if both agree, can backdate separation when filing for divorce. of course you should not trust a woman's agreement for long. can always file for separation first then decide later.
If I file for separation, hdb will not require the hdb to be sold right? Only when divorce? - if both party agrees not to sell it after divorce. share of HDB will be split but it can also remain unsold but depending on court judgement and HDB. because HDB doesnt allow anyone who is not eligible to continue holding a hdb upon divorce (if 35 and above, can hold as single).

Hi. Thanks so much for the advices.
I知 already sleeping in separate room.
I will not contest for the hdb since I want my daughter to have a roof over her head. Plan is to get back my cpf contribution for the hdb.
If both agree on filing for separation, do I look for a lawyer to kickstart the process?
Thanks.

Actually the laws have caught up somehow with the previous draconian WC. I would say 50/50 unlike the earlier years. You'll have to find a good lawyer to fight it out though. Not cheap to win nasty divorce fights...

Why do you wish to get divorce? Is there someone else you wish to marry?
Seems like you wish to have custody of thr 2 children. After getting the divorce, you may lose custody of your children (and therefore regular access to them). You may have to pay alimony and child maintenance monthly. So why get divorce unless you have someone else you wish to marry? Can consider living separate lives and you continue to have your fun outside. At least you will be living with your 2 children

yes WC has evolved a bit
but this is mainly with regards to alimony and settlement. last time only husband pay wife, rarely have cases where wife pays husband. Now is more towards 50/50 and more cases of wife paying husband for cases like wife earns more / wife divorce handicap husband / husband is homemaker.
child custody wise pretty much still unchanged.

Custody most of the time will end up 50/50. Not much of an issue tbh if child is Singaporean. For care and control, that's the part where financial power, network of caregivers and family support comes into play. There's also MSF that can do child evaluation to see who's the better caregiver for the well being of the child.
Nevertheless, main issue is that it'll be costly to fight a messy divorce. My take is that if want to fight, then make sure you fight to win. Don't put in half baked efforts and money to get an unsatisfactory result.
