AN UNEMPLOYED man who raped an 18-year-old girl was sentenced to 5 1/2 years' jail and six strokes of the cane on Friday.
Eric Cheng Kok Yong, 25, pleaded guilty to the offence at his Yishun flat sometime in January last year.
A district court heard that Cheng bumped into the girl, whom he had lost contact with, as she was walking home late one night in January last year.
He asked for her contact number and then sent her an SMS to meet him at his void deck for a chat.
The pair met and later decided to go for supper.
He asked her to follow him home as he had left his wallet at home, but she refused initially. She gave in after much persuasion.
He took her home and raped her in his brother's bedroom.
After that, he apologised to the victim, who ignored his apology and said she wanted to leave.
Around the middle of the year, the victim, now 19, told two former boyfriends that she had been raped. They advised her to make a police report but she did not.
It was only on Jan 28 this year that her current boyfriend took her to make a report.
Cheng's lawyer Gurdaib Singh said his client deeply regretted the offence and was remorseful.
Cheng, whose sentence was backdated to Feb 6, could have been jailed for up to 20 years and liable to fine or to caning.

With current technology, its very easy to trace back events which happen even 10yrs ago or more.
Since he has been sentence, the guy most probably did use his small head to think rather than the big one.
Understand that some girls at that age may be afraid to report due to several reasons, but maybe she just wanna get some profits/advantage out of it by reporting after 1 year
Maybe her bf(s) tot she could get some kind of money out of the guy but he refused....so many maybe(s)..
Not our problems also :D

i thought that after some period of time, the sperms and what you leave on the girl go away normally? :D
or could it be that she keep the Dress with the stain just like Monica Lewinsky?? :D
anyway in general, the polis advise for Rape Victim
"DONT BATH"
Retain any and all clothings u were wearing
see a locter immediately so they can use a RAPE KIT  on you.
Rape kit - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/Rape_kit)
disclaimer: article may shock or dismay any girls because the "Suggested Medical Examiation If You Got Raped" doesnt sound very nice.
it does however say that After 72 hours it is unlikely that any evidence can be collected with a rape kit and the use of the kit may not be necessary.
hmm 10 years later who knows your FB might yell RAPE!!!!
Many years ago, there was a rapist who raped 2 girls within a few days. One of the girls, after reporting had sex with her bf the very nite.
Don't get me wrong, my reply doesn't mean I am in defence of the rapist, just that why that girl didnt report initially. Maybe she was a willing party, or she was traumatised.

What's reported may or may not be true. I've heard so many cases till i'm at this stage where i can only say, it's up to the victim to decide.

Unless there is clear motive, victims seldom lie. If they had made a false report they are hesistant to testify in court and subject themselves to heavy cross-examination. Similarly, considering the severity of the sentence accused who are innocent will not plead guilty.
Hi bro hihiz, - are you a police officer or lawyer?

Perhaps the confession was coerced. How easy is it just for a gal to cry rape and the guilty judgment is passed immediately on the guy. Too many questions left unanswered especially on the gal and police investigation. After one year any physical evidence properly gone so did police charged him based on hearsay of the gal or did the guy really confess without duress to his crime?

Blame it on the screwed up justice system in Sillypore whereby the SG sluts are painted as victims in such cases.
Fight also no use......SG sluts wins end of the day.
Too bad he not angmo....if not the slut would happily let him do her again and again.......

I personally feel that in sex offence case, I would give the benefit of doubt to the gal. I feel we would never understand the trauma, fear, dignity loss, pain, humilation....... Most of the times, I trust our LAW.

eh, consider the sentence which is light for a rape-find that maybe more to this case. like bro t123 say take after 1 year to report and not really feel the vicitim is scared until 1 year then report.
1) in between still have bf
2) follow a man home, common sense will tell you chances are what type of gal she is but of course not mean that she is a loose gal lah but something fishy about this case

Agreed, because of women's charter. Sometimes the ones implementing it does not understand the true meaning of this ACT, when to follow and when not to follow. Ignorant....

Actually this kind of thing very hard to say one, cannot just put the blame on the guy. One of my friends last time also kena similar thing.
I remember when I was still NSF time, at one of my friend's house playing mahjong. Then his "gf" called and say at his block leow, want to come up. This ger is those ah lian type lah, and when she turned up, can see she wear until damn sexy type, short shorts, cropped top type.
While we were playing mahjong, she go and sit behind my friend and rubba rubba him, rub his chest, rub his groin until he buay tahan ask somebody take over and went with her into the room. :D
Some time later he came out to get a drink and his "gf" also came out wrapped in a blanket and we all heard her say," come back, i itchy again".
Then a few months later, KNN, I got called to be a defence witness, apparently she went to report say she kena raped by him. F**king bitch, anyway, in the end, the matter settled out of court after my friend's father paid the money demanded by the ger's mother.

I read this case on papers, I dont understand too ...
how can the gal made police report after few months ?
how to proof that she is force into sex ??
unless the rapist admit it... i really dont understand
women's charter always side the women... we are always on the losing side, so better be careful when stand too near to gal in MRT or Bus. If accidentally touch the gal, and she shout molest, we also will kenna... no joke about this
This case really proved one thing...dun ever think u can get away with any rape or molest case even if nothing happens to u after a year. Scary man...i think the guilt plus the interrogation skill of the Police Investigator must have played an important part to make the rapist confessed everthing.

Hi bro Frankiestine,
How are you?
I dont really know if there was a confession in this matter. The general position is that confessions are not admissible in court unless the person relying on it can prove beyond reasonable doubt that the confession was obtained voluntarily. There were cases where the courts had ruled certain confessions to be inadmissible on the ground that the prosecution had failed to discharge the burden imposed on them by law. This goes to suggests that confessions have sometimes been extracted from the accused. In a crime attracting capital punishment it is unlikely that the police will extract a confession from the accused where other evidence are conclusive enough. In sexual offences the court will not convict the accused in the absence of other independent evidence apart from the mere complaint of the victim. The fact that his lawyer had advised him to plead guilty suggests that there were other evidence or the accused himself had confessed to his lawyer that he had indeed committed the offence.

maybe he is cheated or conned by the IO (investigating officer) to admit the charges, the IO may have tell him that they have evidence or whatever, the guy scared and sign the statement.
i have a friend , he got charged for CBT case, and the IO sort of "sweet talk him or lie" to him.... telling him that he is sure to be convicted, if he admit, he will get lighter sentence. Then he signed the statement, and when finally he engaged a lawyer, the lawyer say he stupid to sign all this statement.

As case was reported one year later, usually very difficult to charge. Most probably his confession leave the investigator and the prosecutor no choice but to charge him.

SG Law is relatively simple.
Plaintiff is always right, Defendant is always wrong.
To win the case, defendant must prove his innocence.
but until then, defendant is considered guilty.
"Eg: Man A said he saw Man B throw a pad down from his flat, Man B cannot find a alibi hence he is guilty till further evidence is brought up. Let say he was sentence to life imprisonment and after serving 5 years, there is a witness to say during that particular time, he was spotted somewhere else. Hence case would be brought up again but he had already served 5 years of innocent jail term"
This is what you call... JUSTICE!
I believe in army, justice is much simplier... Do you remember your enchik saying "do what you want, just don't get caught"

There is some truth in what you have stated. This is because we have a system where the objective is not to let anyone who has committed a wrong escape punishment. So with that, there will be rare occasions where innocent people are punished.
My take on this is: Stay out of trouble's way. Verify all girls that you are going to ONS with.

The 4 of us testified that she acted provocatively and was not forced into the room. But in the end his lawyer said the chances are 50-50 so his father decided not to take the chance and settle out of court. The main reason? Was because got no witness during the whole process of f**king to state that she was a willing party!

Many framed cases in singapore esp in regards to molest/rapes etc ( anything to do with girls )
many years ago, I had a girlfriend whom i loves a lot. ended up she was on the phone with another man every other night.. even went to his house kena fucked by him in her school uniform.
ended up one day i found out by chance and force her to say. She claimed she kena raped and molested by the man ( she followed him home )
forced her to make a police report. a week later, she confessed that she lied to keep me as her boyfriend. poor man already interrogated and almost charged in court.
I quickly brought her to the same police station and claimed that she dont want to pursue. the case was dropped. it was never a case in the first place.
of course, i fucked this bitch last time in my house, shot 3 times without a condom into her and dumped her.
those were the days where we learnt. :)
For the poor man, really sorry dude! well at least he dont have to go to jail like many other poor souls

I find your case rather strange. There must be some salient facts omitted from your post.
In sexual offences which are rather easy to alleged, the court cannot convict an accused purely on the complaint of the victim. It is a requirement of the law that the complaint must be corroborated by other independent evidence. Further, it is the burden of the prosecution to prove that the sexual intercourse was without the consent of the victim. The burden is not on the accused to prove that there was consent. It is therefore, strange that your friend's lawyer had advised him to plead guilty because he cant prove that the act was consensual. The burden is simply not on the accused. Since you are 3 other friends were willing to testify for your friend, your friend's defence had more than a decent chance of succeeding.

When did I say that the lawyer asked him to plead guilty? The lawyer said can fight, but he's not confident, the chances are 50-50. That's why my fren's father agreed to pay the ger's mother and she discontinued pressing charges. He never said; "plead guilty, you sure lose one, wash your backside clean clean and prepare to be someone's bitch."
