View Full Version : Citizenship Headache
Hi Bros,
I really need some help....
I just have a newborn baby in Vietnam with my Vietnamese "wife" - We are not officially married.
Now, I need to apply Singapore citizenship for my baby. I have checked with ICA and they says that I need to get married first with my "wife" and also need to produce the brith certificate of the baby indicating I am the father.
However, the hospital which issue the birth certficate did not indicate my name. Problem....:(
Any bros have such problem and solution, I would greatly appreciate for some advice. Thank you.

Interesting problem which I may need a solution some time too...
Camp! :D
But just logically speaking, can't you simly approach hospital or birth registrar there to add your name as the father?

Bro look like you need to get your "wife"to Spore to ROM first before you can settle the child citizenship.
I also had a vietnamese girlfriend, so go around asking and checking the procedure.
If your child is born in Vietnam and she is not married to you yet, you need to go to the local municipal office or police station to swear-in with your girlfriend. It like a local process to show you are the father of her child. There is a fee to pay but i dun know how much as you need to check with the local government office.
Ask you girlfriend or her relative to go to the police station to ask first.
After that go back to the hospital to amend the birth certificate.
I have heard many versions on registering the child and you really have to ask around.
Forget about asking ICA or Singapore Consular in Vietnam, they cannot really help you.
Once you have the proper documents ready then go ICA, but you have a maximum of 12 month to register your Child, if not need to explain to ICA in writing on the delay.
I know its not much help and you need to make a trip to Vietnam to settle it.
All the Best and Congrats.

Is because u are not official marry thats why the birth cert dont have your name
Marry her officially there, with the marriage cert check with the local hospital whether can include your name or not,if cannot it can do done, money can settle everything there, your 'wife' should know how to go about it.:)

almost 100% fool proof verification ... Deoxyribonucleic Acid test
but need 2 spend $$$$
http://sg.theasianparent.com/articles/paternity-dna-testing/
i believe most of the hospitals in sg would hv a genetics lab capable of performing such a test, but u may hv 2 check with them as 2 whether they will do paternity testing.
Most of them usually focus on finding genetic defects or diseases.

Bros,
Thank you all for your kind reply.
It seems that there will be a lot of running here and there to do and money to be spend... :(
The problem is that I am a foreigner so there may be a lot of issues. I guess most important is to get married first then go one step at a time.
I wonder can I buy a valid official married certificate in Vitenam? I don't mind spending some money to cut short the time. :)

Bro, you say you are foreigner ? then why you are registering the child for Spore Citizen??
For Spore Citizen, be it man or woman, if our child is born abroad or one parent is not Sporean at least can apply the child for Spore Citizenship by Descent.
I don't know your status in Spore (PR, Work Permit or S-Pass etc...) but you better seek advise from the right government authority (ICA or MOM).

Firstly, if you and your gf are not officially married, the child's birth certificate will not have your name. Without your name in the birth cert, you can forget about getting citizenship for your child. In order for you to insert your name in the child's birth cert, you need to marry your gf first. After marrying her, you need to make a declaration that the child is your's. Upon which, you can apply to `adopt' the child under yr surname. But this is at the vietnam side.
At singapore side, you will face even greater challange. As the date of your marriage certificate is later than the birth date of your child, you need `proof' that the child is really yours. I shan't make it so clear as to how you can proof the blood relationship. When proven, ICA will consider your application for your child to be Singapore citizenship. But let me tell you first, there are many singaporean man with the same situation as yours and even with proof, ICA still didn't grant their child citizenship. You should be strong in your education level and financial stability.

Hmm.... So TS need to "back-date" the marriage cert (before the baby's birthday) in Vietnam for better chance. At least with some $$$, this can be done over there, I presume.
What is the deadline to register the kid in Singapore if all else is OK? Is it within 1 year of the baby's age? Or before 18yo? I know we can change the name of baby within 1 year of birth registration, the 18yo thingy is for NS stuffs (I think) what about citizenship registration?

IF you are NOT Legally Married in Vietnam or Have NOT gooten your ROM cert recognised in Vietnam ...
You CANNOT put your NAME as FATHER in the Birth Certificate ..
Hospital in Vn will NOT issue Birth Certificate ... They only Issue a Letter of Live Birth which will ONLY indicate the Baby's MOther Name ... IF you want your Name to be indicated in it , you HAVE to TELL the hospital to do so ... which I have Done it ...
Then you will bring this letter to 'So Tu Phap' or 'Phuong Tu Phap' to register a Birth Cert for your child ... then you have to product your marriage cert to confirm adn you name will be added into the birth certificate ...
Forget about asking ICA or Singapore Consular in Vietnam, they cannot really help you..
Wrong advise !
Singapore COnsultate in HCMC is the one who advised me how to do it and advise me where to get the translation done.
I submitted the application thru them but I collected my baby SC in ICA SIngapore.
My baby enters Singapore using Vietnamese Passport and recieve a '21 yrs right of Entry' chop on my Baby Vietnamese Passport in ICA.
Once you have the proper documents ready then go ICA, but you have a maximum of 12 month to register your Child, if not need to explain to ICA in writing on the delay.
You CAN apply for Citizenship ANYTIME ...
IF you do it within 12 mths ... ZERO documents will be submitted, just the normal application forms plus some basic documents like Birth Cert, MArriage Cert ... etc
IF you exceed 12 mths ... tons of documents to submit ... Birth Cert, MArraige Cert, Letter of explanation, 12 mths CPF COntribution, Educational Certs , Income TAX for last 3 years , Letter of Employment and etc etc ....
you need to make a trip to Vietnam to settle it.
Once you have ALL the necessary documents, you can bring back the documents and submit the application and have it processed in ICA Singapore.
You do not need to go Vietnam to do it .... you can do your translation in Vietnam Embassy in SIngapore ... only things is Expensive.
I know its not much help.
Because you have not experienced it and do not know the process ....

if the father is a SC ... he can indicate in the Vietnamese Birth Certificate that the baby is a Singapore Citizen ....
However there is some limitations imposed on the child ... she will not be able to do a vietnamese passport .. and in case she is not awarded a SC , she will have a big problem in vietnam subsequently ...

Marriage in Vietnam is hell lot of problems ... need to spent $$, Get Approval from the Government Office, Get Singlehood Certificate and etc ..
My wife's cousin got married to a China National in Vietnam , they spent about USD$500 undertable $$$ to done up the paperwork ....
Get it recognised is much easier ...
Solution :
??? You can check with ICA if you can apply for your child SC by adoption or some other categories but is a more painful process ... Easy and less painful way is to get marrried :)
1st ... ROM in Singapore ...
2nd ... Get your Marriage in SG Recognised in Vietnam ...
Note:
I try to get this part done, however the Government office mentioned to my wife that they Recognised our SG Marriage and Do not need to get it Recognised. Therefore can straight away register us as parent in the baby's birth certificate.
PLease find out this as My wife is not from HCMC and is from Binh Duong ... probably different City may have different requirements ...

not as simple as what you put it. when the marriage date is later than the child's birth date, it is going to bring him great problems at ICA when applying for child's SC. ICA will need him to prove relationship even though his name is already in the child's birth cert.

Yes , I agree that it is not that simple as there is Nothing in the world is as simple as we thought ...
Under the application, If we can apply for SC for child who is adopted by our spouse ... I believe it is not as complicated ... I believe there will be some obstacles / problems but NOT to an extent of 'great problems' ...
If I am NOT wrong (PLease correct me), I think the mother of the adopted child who is the wife of an SC can even apply for Baby Bonus ...
I cannot not agree because you are a far more experienced BRO than me ;)
But then sometimes it is also not as complicated and difficult as we thought so ...
Not matter how, married with name in birth cert is definitely AN ADVANTAGE under this circumstances ...

How come my lengthy post didn't show up?
To cut short...
Under the Article 122(1) of the singapore constitution, you did not fulfill the requirements of 1, 2 & 5.
As Bro Singviet has sum up in whole, and fortunately you have 12 months with the birth of your child to submit the requirement documents to ICA for the application of the child citizenship.
You may want to consult the Consulate-General of Singapore in Ho Chi Minh City, to discuss with them whether your problem is within MHA's area of assistance or not.
I relate one case to you. My colleague married a filipina wife in philippines. They had a baby girl in philippines. He took almost two years to complete the formalities for his daughter citizenship. He made multiple trips to ICA, numerous official translations for the documents, made statutory declarations, and obtained a DNA report from HSA to proof their paternal relationship. Understand from him, he has also seek help from Singapore Embassy in Philippines.
Time is running up as it passes by. Please follow up without any delay.
I wish you well. :)

From the AThe problem for TS is this condition "at the time of minor's birth". The baby already born before they get married so this is more tricky. First matter to solve is to get your name into the birth cert as the father. I heard from a friend that the mother of the child can do this by making a declaration at Su Thu Phap, 141 Pastuer Street, HCM that you are the father. Documents needed are her ID, letter from the hospital of birth, your passport and both of u need to be present to make the declaration. This is for cases that the couple are not married yet.
Anyway, you should go to the office there to find out more details.
Because you dilly dally until the child is born before you take action, so now the process is much more complicated. Pls post your updates on this so other bros can learn from your experience.
Hi Bros,
Finally, I got married in Singapore after all the waiting. Now, I will have to proceed to the next step.
My next headache is my wife is not from HCM. She is from Hai Duong in the North.
We went to Su Thu Phap to enquire and they mentioned that all the paper work need to be done in her hometown. Even registering my baby name although she is born in HCM. OMG............
Now priority is to get my name in the birth cert first. Tired........

sharing with you my case 3 years ago. My then prc gf which is my wife now gave birth to my son in guangzhou and we were not marry at that time as i going thru a divorce. After consulting ICA, they require us to be legally marry before they could do anything. Finally we got marry when my boy was 8 months old. After a very tedious process which make me visit ICA for 5 times, I manage to land my son citizenship when he is 16 months old. I have problem with the china birth cert too bcos I was not of chinese origin and my name has 18 alphabets and was too long for the chinese birth cert so the hospital in GZ delete my middle name from my son birth cert. because of this I was grill badly by ICA and in the end was make to write a formal letter to explain.
