The husband can't use the flirting smses against u. He could only uses them as evidence against his wife for adultery and proof for divorce. If he replied u back wif threats, turn the table and use his threats as blackmailing against u.

Based on the previous 2 replies. Conclusion is your friend wins.

1) Married men threaten with SMS, no case unless they wanna divorcé, but it is non of your business. Can bo chap

2) Married men threatens your friend, you friend can sue him for blackmailling.

Conclusion, tell your friend to ask the married men to stop the nonsense if not you'll take him to court for blackmailing, harassment, verbal assault and causing distress :)

If he tends to threaten or blackmail your friend. Ask him to blog about the whole incident online, in the worst case everyone got ruined in their reputation =)

At most he can use the evidence for a divorce not for adultery . However if the sms is very explicit with details of place , time, room and what they did . YES

If you are asking whether SMS is admissible as COURT EVIDENCE i would have to say.... 70%: there are precedents in US Courts that SMS is brought up in front of the judge

http://www.textually.org/textually/archives/2010/12/027390.htm

SOme quick searching also turned this up
http://www.zdnetasia.com/blogs/singapore-blazes-into-e-discovery-of-evidence-62100799.htm

Increasingly, a lot of litigation involves some element of electronic document--e-mail, SMS messages

and

there is enough precedent of Sms being used as proof... so the answer from me is

Sms = evidence = YES :)

Flirting by SMS is not a crime, so he can't use any law on your friend. (Adultery is also not a crime.)

However, if he uses that as proof of adultery between your friend and his wife for divorce, your friend can be named in the suit as 3rd party and may be sued to compensate him money.

I am not sure of the details, but I know someone, when his wife filed for divorce, the court also served papers on his mistress.

Tell you friend go and consult lawyer. Usually the first meeting with lawyer is free or just a $50 to $100. Can call the law firms to find out the price before meeting. Look for a lawyer that specialises in civil and divorce cases.

Of course, the joker can try to blackmail your friend with unwanted publicity, or maybe threaten to tell your friendss wife/gf/family, etc.

Just be careful with flirting with somebody wife. You never know what you will get in return.

Esp if u are married as well. A moment of lust but lifetime regrets.

Tell your friend not to worry if he is single.

there is no Singapore law that say you cannot flirt
if the husband wants to settle this by law, is impossible
unless he wants to handle it in the gangster way, paying some thugs to beat the guy up
the man can also defend himself by saying that he didn't know this woman is married when he flirted with her

Eh anyway yes the SMS is evidence...
Considered electronic evidence

1) but evidence for what?
That the wife had stray thoughts? not illegal, no grounds to divorce
That he flirted with the wife? not illegal, nothing to be scared of
That he screwed the wife? not illegal, in fact proves that it's between 2 willing parties

2) blackmailed for what?
damage to the guy's reputation? that's not blackmail, it's called buying off people. legal. happens all the time
damage to the wife's reputation? same as previous, it's just paying for silence. legal.
did the hubby threaten with bodily harm to anyone? is it really considered blackmail in the first place? :)
