PANEL TO PRESENT REPORT BY 15 JANUARY 2006

KUALA LUMPUR: The Commission of Inquiry has vouched to come up with a report on the naked ear squats incident by Jan 15 after concluding its hearing yesterday.

The four-day inquiry heard testimonies from 16 witnesses including Deputy Inspector-General of Police Datuk Seri Musa Hassan, other senior police officers and a Malaysian woman who identified herself as the woman who was shown doing ear squats naked in a video clip.

Commission chairman Tun Mohamed Dzaiddin Abdullah said the four-member panel would study all the evidence that had been put forward as well as the closing submissions made by leading officer DPP Suhaimi Ibrahim before making the report and submitting it to the King.

The commission was set up after the video clip was made public in Parliament on Nov 24.

The inquiry aimed to ascertain the identity of the woman in the video clip, scrutinise the body search procedure as seen in the clip and investigate the police’s standard operating procedure, rules and regulations pertaining to the body search of detainees, and recommend amendments and changes to the procedures, if necessary.

In his submissions yesterday, DPP Suhaimi, who was assisted by DPPs Nordin Hassan and Kwan Li Sa, said:

·It could be safely concluded that the Malaysian woman who testified at the inquiry was the woman performing ear squats in the nude in the video clip,

·It would be very unreasonable to suggest that the woman in the video clip was one of the five female Chinese nationals (who had alleged police harassment) since there was no evidence to suggest so,

·The body search carried out on the woman as seen in the video clip was not unjustifiable, except for the fact that it was recorded and distributed.

·The manner of body search as seen in the video clip provided a better option than a body search which required physical contact with the suspect such as using the index finger or other necessary apparatus to retrieve any substance hidden in the private parts.

Lawyer S.N. Nair, who represented the four female Chinese nationals – listed as witnesses but not called to testify at the inquiry – also handed in his suggestions and comments to the panel.

He set the record straight that Seputeh MP Teresa Kok had never said that the woman in the video clip was a Chinese national.

Apart from the former Chief Justice, the commission’s members are former human resources minister Tan Sri Lim Ah Lek, former Bar Council chairman Kuthubul Zaman Bukhari and Wanita Umno legal aid bureau chief Datuk Kamilia Ibrahim.

Commission secretary Datuk Hamzah Md Rus was also present throughout the hearing.

‘COMMISSION DID NOT DIG DEEP ENOUGH’

KUALA LUMPUR: The Commission of Inquiry should have delved deeper into the police’s application of strip searches on criminal suspects, the Bar Council believes.

Council chairman Yeo Yang Poh said the issue of improper search procedures should have been fully investigated before the four-member commission wrapped up the inquiry.

He said police seemed to arbitrarily conduct strip searches on detainees.

“That, to us, is unacceptable and must change. It violates existing laws, namely, the Criminal Procedure Code, which states that any body search must be performed with strict regard to decency,” he said.

Yeo made an application to Commission chairman Tun Mohamed Dzaiddin Abdullah at the end of the inquiry yesterday contending there were points which had not been sufficiently dealt with and asked to be given five minutes to argue on those areas.

Dzaiddin dismissed the application, saying that the Bar’s representative was only granted observer status and therefore could not make submissions.

Meanwhile, Deputy Prime Minister Datuk Seri Najib Tun Razak reminded the people not to make a racial issue of the naked ear squats incident.

PETALING JAYA: The woman featured in the video clip doing ear squats in the nude testified on Tuesday before the Commission of Inquiry probing the incident.

She is a 22-year old Malay, and is currently three-months pregnant.

Clad in a black coat over an oversized baju kurung and a black tudung (headscarf), the woman testified for 50 minutes before the Commission of Inquiry with her back facing pressmen and the public.

The media was prohibited by the four-member commission from publishing her name, photographs and personal details to protect her privacy.

When she finished giving evidence, she was whisked away by two plainclothed policewomen with her head completely covered by a jacket.

Commission chairman Tun Mohamed Dzaiddin Abdullah earlier dismissed an application by leading officer Suhaimi Ibrahim to bar the press from covering the proceedings.

"This is a public inquiry, the proceedings must be open and transparent," he said.

The petite woman started her testimony at 9.45am by saying that she was "a 22-year-old Malaysian of Malay descent".

She then revealed that she had gotten married on Sept 25 and was currently three months pregnant.
